AIRPORT GENERAL LIABILITY POLICY

Primary Policy Coverages

(1)  Premises Liability (also known as Commercial General Liability):
This coverage provides insured party with a paid legal defense should they be sued for bodily injury, or property damage which arises out of the operations at an insured location. Should a judgment be granted against an insured party, the insurance carrier will pay on their behalf all sums which the insured is liable for up to the policy limits. This part of the policy does not provide protection from suits filed arising out of your products, or services, or for loss of property left in your care. Liability coverage does extend to vehicles that are used at your location that not street licensed. This would include tugs, fuel trucks and golf carts.

(2)  Premises Medical Coverage:
This coverage is designed to pay for minor injury (bodily injury) which happens at an insured location. This helps avoid litigation for minor claims. Medical Coverage limits normally range from $1,000 to $10,000 each person with $5,000 being the norm these days.

(3)  Products and Completed Operations:
This part of the policy provides liability protection for bodily injury & property damage arising out the policyholder’s sale of aviation products, or aviation services they offer. This coverage only comes into play if an accident occurs after the time of delivery of the product or service and the loss occurred during the policy period.  It does not provide coverage for damage to an aircraft while the aircraft is in policyholders care, custody, or control. It also does not provide coverage for, nor is a guaranty of, your workmanship (i.e. It does not provide coverage for fixing poor repairs which have been done to an aircraft and an accident has not occurred).

(4)  Hangarkeepers Liability (Ground - Excluding Flight):
This part provides liability coverage for damage to an aircraft which is not owned by, or leased to the policyholder, while the aircraft is in their care, custody and control (i.e.. while servicing the aircraft for maintenance, fueling it, or storing it).  It only pays for damages that the policyholder is legally responsible for. This coverage is not to be confused with hull insurance it is liability coverage for physical damage to property.

Optional Coverages:

(1)  Off-Premises Liability:
This is an extension of the Premises Liability Coverage to include other locations which are incidental, or necessary to your operation. This coverage is also known as "Incidental Locations Coverage".

(2)  On-Premises Auto Liability:
This is an extension of the policyholders Premises Liability Coverage to an insureds use of street licensed vehicles but only while they are driven on the airport premises.

(3)  In-Flight Hangarkeepers Liability:
This endorsement extends your Hangarkeepers Liability to include coverage for damage to non-owned or non-leased aircraft while being flown by one of the policyholders pilots.  This coverage is not to be confused with hull insurance. It is liability coverage and only pays if the damage is due to the policyholder’s negligence.  (Note: A similar coverage can be added to the Aircraft Policy as Non-Owned Aircraft Damage Liability.)

(4)  Personal Injury Liability:
This coverage provides a paid legal defense should policyholder be sued for damages for injury arising out of false arrest, detention or imprisonment, malicious prosecution, liable or slander, wrongful entry, or other invasion (to persons other than an employee, or an insured person).  Should a judgment be granted against the policyholder, the insurance carrier will pay on their behalf sums which they are liable for up to the policy limit.

(5)  Fire Legal Liability:
This is liability coverage for damage to the buildings that the policyholder rents or leases (on the insured airport premises) which is caused by fire.  It pays for damages only if the policyholder is legally responsible for them.

(6)  Contractual Liability:
This coverage pays on the policyholder’s behalf, should they become legally obligated to pay, by reason of liability assumed by you under a written contract.  Other than incidental contracts, a copy of these contracts must be provided to the insurance carrier.

(7)  Independent Contractors Liability:
This coverage provides protection for Bodily Injury & Property Damage arising out the work performed by an Independent Contractor which is done on your behalf.

(8)  Professional Liability - Negligent Instruction:
This provides protection for claims arising out of an error, or an omission committed in the course of giving flight instruction and which may, at a later date, result in an accident causing bodily injury or property damage. The accident must have occurred during the policy period.

(9)  Advertising Liability:
This provides the insured with a paid legal defense should they be sued for damages for injury arising out of libel, slander, defamation, violation of privacy, piracy, unfair competition or infringement of copyright, title or slogan.  Should a judgment be granted against the insured, the insurance carrier will pay on your behalf all sums which you are liable, up to the policy limits.
